Student and temporary contracts: your rent can still be checked
A student or temporary contract doesn't take away your right to a fair rent. If you pay more than the legal maximum, you can have it checked, and often get money back.
Yes, your rent is protected too
The legal maximum rent depends on your home, not on the type of contract. A student contract, a temporary contract or a room in a shared house: the points system still sets the highest basic rent your landlord may ask.
Renting a room with a shared kitchen or bathroom? Rooms have their own points system, and every room has a legal maximum rent.
Contracts signed from 1 July 2024
You can ask the Huurcommissie to check your starting rent within 6 months of the start of your contract. If it was too high, the lower rent counts from your first day, and you can claim the overpaid months back from your landlord.
Most students move in around August or September, so for them this window closes around February or March.
Older temporary contracts: more time
Signed a temporary contract of up to 2 years before 1 July 2024? Then you can still ask for a check until 6 months after that contract ends.
After the 6 months
Missed the window? You can still get your rent lowered from now on, based on the points of your home. It just doesn't count backwards.
Will it cost me my room?
Asking the Huurcommissie is your legal right, and it isn't a legal reason for a landlord to end your contract. If you're worried: the rent check is free, and nothing reaches your landlord unless you decide to go ahead.
